Reasons

Mr Cheng and Mr Zhou attended today’s hearing for the landlord. The tenant did not attend.
This was a four-year tenancy that ended on the 8 June this year.
The landlord has applied for rent and water rates owing at the end of the tenancy and compensation for rubbish removal, cleaning, carpet cleaning, replacement of a windowpane, damage to the carpet caused by an iron and replacement shower handles.
The landlord also seeks reimbursement of the filing fee and to be paid the bond to reduce the amount owed by the tenants. Rent and Water.
The landlord provided rent records and water statement which prove the amount owing at the end of the tenancy. Cleaning and rubbish removal.
At the end of the tenancy the tenant must leave the premises reasonably clean and tidy and remove all rubbish. 1
I am satisfied that the tenant did not leave the premises reasonably clean and tidy, including the carpet which appears dirty and stained and did not remove all rubbish because the landlord provided me with photographs of the premises taken by him on the vacant date. They show a property that is not reasonably clean and tidy, and a considerable amount of rubbish left both in and outside the property.
The landlord had contractors complete rubbish removal, carpet cleaning and cleaning. They provided invoices for that work. I am satisfied that the invoiced amounts were reasonable for the work that was required to be done.
Compensation should restore a party to the position that they would have been in had the other party not breached the RTA. If the tenants had left the property clean and tidy and removed their rubbish, then the landlord would not have had to pay someone else to do it.
The landlord is awarded the amount they have paid their contractors. Damage to the window, carpet and shower handles.
A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the 1 See section 40(1)(e)(ii)-(iii) Residential Tenancies Act 1986. damage. Tenants are liable for the actions of people at the premises with their permission. 2
Fair wear and tear is the decline in the condition of a property due to ordinary, everyday use.
I am satisfied that the windowpane broke, the carpet became damaged from being burnt with an iron and the shower door handles were broken during the tenancy. I am satisfied that the damage is more than fair wear and tear and the tenant is liable for the damage because: a. The landlord provided me with entry report and exit inspection photographs. The window was not broken at the beginning of the tenancy, the carpet was new and unstained, and the shower doors had handles. b. This damage does not occur as a result of ordinary use.
I am satisfied that the landlord has replaced the window pane and the shower door handles and award the landlord the costs of those repairs.
The landlord has not had the carpet replaced, but I am satisfied from the photographs that the burn is in an obvious place and the carpet will need replacing in this room much sooner that the landlord would have expected. I have therefore awarded an amount that reflects that.
I have taken into account betterment and depreciation. The landlord should be returned to the position they would have been in had the tenant not breached their obligations, and should not be better or worse off. In calculating depreciation, I have taken into account the age and condition of the items at the start of the tenancy and their likely useful lifespan. Filing fee.
As the landlord has been successful, I award the landlord the filing fee.
