The landlord attended the hearing on 7 April 2026. The tenant did not.
On 13 August 2025, the Tribunal made an order requiring the tenant to pay the landlord $977.82. The tenant has not made any payment towards this debt. Therefore, it is appropriate that the terms of the previous order be incorporated into the terms of this order for enforcement purposes.
The landlord has applied for rent arrears, compensation and reimbursement of the filing fee following the end of the tenancy.
As the applicant, the landlord must prove their claim to the civil law standard of proof, on the balance of probabilities.

Where a tenant remains in occupation of the premises after the tenancy has terminated or has been terminated, all the obligations of the tenant continue in force as if the tenancy were still subsisting, until such a time as the tenant ceases to occupy the premises. 1 Analysis
The tenancy ended at 11:59pm on Wednesday, 27 August 2025 by order of the Tribunal. The landlord gave evidence the tenant continued to occupy the premises until 8 September 2025 when they returned the keys, and the landlord completed an exit inspection. In the absence of any evidence to the contrary, I accept the landlord’s evidence.
I find the tenancy ended on 27 August 2025 however, the tenant remained in occupation of the premises until 8 September 2025. Therefore, the tenant must pay rent up to this date. The landlord submitted a rent summary, which proves rent arrears up to 8 September 2025 are $2,478.55. The landlord has already received an order from the Tribunal for rent arrears up to 13 August 2025 totalling $3,314.29. Therefore, the landlord’s claim for rent arrears is granted from 14 August 2025 – 8 September 2025 for a total of $2,414.10 (26 days). 1 Residential Tenancies At 1986, section 60(1).

The photographs taken at the end of the tenancy show the inside of the premises were left in a reasonably clean and tidy condition, except the kitchen. The kitchen cupboards and drawers are dirty and have not been wiped down. There is rubbish in one of the kitchen drawers. The oven and rangehood are also dirty. For these reasons, I find the tenant did not leave the kitchen reasonably clean and tidy.
The landlord submitted an invoice for $195.50 to clean the kitchen. The photographs taken at the end of the tenancy show the lawns are overgrown and full of weeds. There is also a small amount of rubbish and personal belongings scattered throughout including, children’s toys, pots and containers. For these reasons, I find the tenant did not leave the lawns reasonably clean and tidy.
The landlord submitted an invoice for $169.62 to mow the lawns and remove the rubbish. The landlord’s claim for compensation is granted for this amount. Rubbish
The photographs taken at the end of the tenancy show a lot of rubbish was left at the premises. The garage is full of rubbish, including bedding and old furniture. There is also a broken down trampoline, wooden pellet and bin full of rubbish. For these reasons, I find the tenant did not remove all rubbish at the end of the tenancy.
The landlord submitted an invoice for $874.00 to remove the rubbish. The landlord’s claim for compensation is granted for this amount. Keys
The landlord submitted a copy of the entry report. It includes a photograph of a set of keys that were provided to the tenant. The landlord gave evidence that one of the keys was for the deadbolt on the front door. The landlord gave evidence this key was not returned at the end of the tenancy. I accept the landlord’s evidence and find the tenant did not return the key for the front door deadbolt at the end of the tenancy.
The landlord submitted an invoice for $149.50 to replace the key. The landlord’s claim for compensation is granted for this amount.

Is the tenant responsible for damage that occurred during the tenancy?

The law

A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission. 9
Fair wear and tear has been described as the deterioration of premises due to both reasonable use and ordinary operation of natural forces, reasonable conduct on the part of the tenant being assumed. The amount of damage is not relevant. 10 Garage window
The landlord submitted photographs of the garage taken at the beginning of the tenancy. None of the windows are broken. In contrast, the photographs taken at the end of the tenancy show a broken window in the garage. The entire glass pane is smashed.
I find the garage window was damaged during the tenancy. The damage exceeds fair wear and tear, and the tenant has not disproved liability.
The landlord submitted an invoice for $273.06 to repair the window. The landlord’s claim for compensation is granted for this amount. Cat door
The entry photographs show there is a cat door attached to the back door. The landlord gave evidence the cat door had been ripped out at the end of the tenancy. The landlord did not submit a photograph of the damage, but instead submitted a photograph of the back door with the cat door boarded up.
The invoice to repair the cat door states: Cover over the cat door removed from the door previously...
This supports the landlord’s claim that the cat door was removed during the tenancy.
On the balance of probabilities, I find the cat door was removed and damaged during the tenancy. The damage exceeds fair wear and tear, and the tenant has not disproved liability.
The landlord submitted an invoice for $46.00 to cover and repair the cat door. The landlord’s claim for compensation is granted for this amount.
All of the amounts ordered are proven.
I have taken into account betterment and depreciation. The landlord should be returned to the position they would have been in had the tenant not breached 9 Residential Tenancies Act 1986, sections 40(2)(a), 41 and 49B. 10 See discussion in Accessible Properties New Zealand Ltd v McKeefry [2019] NZTT 4114629, 4169403. their obligations, and should not be better or worse off. In calculating depreciation, I have taken into account the age and condition of the items at the start of the tenancy and their likely useful lifespan. Should the tenant pay the landlord two $1,392.75 in lost rent?
The landlord claims the tenant’s breaches contributed to a delay in re-tenanting the premises. In particular, the landlord points to the amount of rubbish and personal belongings left at the premises by the tenant. The landlord seeks compensation of $1,392.75 in lost rent for the period 9 September 2025 – 23 September 2025. The landlord claims this is the time it took to return the premises to a reasonable condition to advertise for rent.
The general law provides that if an applicant has suffered damage that is not too remote, then they must, so far as money can do, be restored to the position they would have been in had the breach not occurred. Compensation cannot be recovered for all types of damage and a line must be drawn somewhere. Therefore, the law does not permit compensation for damage that is considered to be too remote. Recovery is limited to actual loss resulting from the breach that was reasonably foreseeable when the contract was made.
In this case, I am satisfied that by leaving a lot of rubbish and personal belongings at the premises, the tenant’s conduct contributed to a delay in advertising the premises, which ultimately contributed to a delay in re-tenanting them. This is because the landlord was required to make all reasonable efforts to first contact the tenant and organise a time for the tenant to pick up their belongings under section 62 of the RTA. The landlord was unable to simply dispose of the tenant’s goods and return the premises to a reasonable condition immediately.
Whilst I am satisfied that the tenant’s breach contributed to a delay in re-tenanting the premises, I am not satisfied the delay is equivalent to $1,392.75, which is almost two weeks in rent. This is because there is usually an inevitable delay in re-tenanting premises, because it takes time to advertise, vet prospective tenants and in some cases, tenants need to give 21 days’ notice to end their current tenancy before beginning a new one. Keeping these factors in mind, I find the tenant’s breach is only likely to have resulted in a delay of one week in re- tenanting the premises. For this reason, the landlord’s claim for lost rent is granted for $650.00, which is equivalent to one weeks rent. Filing fee and name suppression
Because [The applicant/s] has wholly succeeded with the claim I must reimburse the filing fee. For the same reason, I must grant their request for name suppression.

Whilst I am satisfied that the tenant’s breach contributed to a delay in re-tenanting the premises, I am not satisfied the delay is equivalent to $1,392.75, which is almost two weeks in rent. This is because there is usually an inevitable delay in re-tenanting premises, because it takes time to advertise, vet prospective tenants and in some cases, tenants need to give 21 days’ notice to end their current tenancy before beginning a new one. Keeping these factors in mind, I find the tenant’s breach is only likely to have resulted in a delay of one week in re- tenanting the premises. For this reason, the landlord’s claim for lost rent is granted for $650.00, which is equivalent to one weeks rent. Filing fee and name suppression
