The landlord’s representative and Waiora Te Tomo attended the hearing held remotely today. Steven Lee Berryman did not attend. I continued the hearing in his absence because he has been sent notice of the hearing date and time to his email address for service and received text reminders.

This was a joint tenancy from 20 August 2022 and ending on 29 July 2025 after the tenants gave notice.

The landlord has applied for payment of rent arrears, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.

The landlord provided rent records which prove the amount owing to the end date and the tenant agrees this is correct. I award $1,752.85.

The tenant agrees the property was not left reasonably clean and tidy, that the outdoor areas needed garden maintenance, and that some belongings were left behind and were disposed of by the landlord.

The claims are supported by photographs taken at the final inspection and are awarded at the invoiced amounts.

The photos also show numerous scuff marks around the lounge and dining room walls at the height of the furniture used in these rooms. Some of the cleaning cost relates to attempts to remove these.

I am not satisfied that the scuff marks are due to careless use by the tenants. The landlord said the walls had been painted immediately prior to this tenancy. Paintwork should be able to withstand furniture up against it. After discussion, it was agreed that the tenants would pay for the extra cleaning to try to remove the marks but not for repainting costs. The claim for these costs is not awarded.

The tenants were responsible for swimming pool maintenance. Photos show, and the tenant accepts, that the pool needed a lot of cleaning and chemical rebalancing at the end of the tenancy to bring it back to working condition. After discussion in the hearing, some costs have been deducted from the invoices for replacement of pool tools and fittings. The balance is awarded.

The filing fee is awarded to the landlord.

The bond is refunded to the landlord.

The balance of $3,083.78 is owing by both tenants jointly. The landlord has agreed to a repayment arrangement for half of this amount with Waiora Te Tomo. The landlord has the option to seek repayment of the remaining $1,541.89 as it sees fit.
