The landlord asked for a further 2 weeks’ rent as compensation. Making an Order for that much lost rent would involve too much speculation on the Tribunal’s part about when a new tenancy might begin. The landlord is able to make further application when a new tenancy starts and the amount of his loss is quantified.

The landlord has provided rent records and water rates invoices which prove the amount owing.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. 1

Exit inspection photographs prove that the tenant did not leave the premises reasonably clean and tidy and left a very large quantity of rubbish. The tenant did not return the keys.

The landlord paid to have cleaning work done, to have locks replaced and to have the rubbish removed. The amount paid by the landlord is proved by the invoice provided. The landlord should be compensated for that loss. 1 See s.40(1)(e)(ii)-(v) RTA

Is the tenant responsible for the damage to the premises?

A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage.

Tenants are liable for the cost of repairing damage that is intentional or which results from any activity at the premises that is an imprisonable offence. This applies to anything the tenant does and anything done by a person they are responsible for.

The exit inspection photographs show damage that appears more likely than not to have been intentional. A door was split, there was wall damage. Repair and painting was required.

The landlord has provided the contractor’s invoice proving the cost incurred by the landlord to have the repair work done. The landlord should be compensated for that loss.

The landlord also needed to have a plumber attend to fix a leak caused by the way the tenant disconnected laundry connections. I am satisfied the tenant is responsible and the landlord should be compensated for the cost as proved by the invoice provided.

Because [The applicant/s] has succeeded with the claim I must reimburse the filing fee.
