The tenant must also replace standard light bulbs.

The following chattels were missing at the end of the tenancy: a. Heater; and b. Curtains.

Is the tenant responsible for the damage to the premises?

A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission. See sections 40(2)(a), 41 and 49B RTA.

Where the damage is careless, and occurs after 27 August 2019, section 49B RTA applies. If the landlord becomes aware of the damage after 27 August, the damage is presumed to have occurred after that date unless the tenant proves otherwise.

Where the damage is caused carelessly, and is covered by the landlord's insurance, the tenant's liability is limited to the lesser of the insurance excess or four weeks' rent (or four weeks' market rent in the case of a tenant paying income- related rent). See section 49B(3)(a) RTA.

Where the damage is careless and is not covered by the landlord's insurance, the tenant's liability is limited to four weeks' rent (or market rent). See section 49B(3)(b) RTA. Where insurance money is irrecoverable because of the tenant's conduct, the property is treated as if it is not insured against the damage. See section 49B(3A)(a) RTA.

Tenants are liable for the cost of repairing damage that is intentional or which results from any activity at the premises that is an imprisonable offence. This applies to anything the tenant does and anything done by a person they are responsible for. See section 49B(1) RTA.

Damage is intentional where a person intends to cause damage and takes the necessary steps to achieve that purpose. Damage is also intentional where a person does something, or allows a situation to continue, knowing that damage is a certainty. See Guo v Korck [2019] NZHC 1541.

The following damage was caused during the tenancy: a. Carpet and underlay patch rear lounge due to dog damage; b. Carpet replacement front lounge due to dog damage and pet odour that could not be remedied; c. Dog damage to 14 doors- scratches and chewing; d. Toilet seat in back house damaged; e. Dog damage to vinyl in open plan dining, kitchen and laundry; f. Holes in walls through two houses; g. Dog damaged door frames; h. Three door stops missing or damaged; i. Stove damaged with cockroach infestation that did not exist during the prior tenancy.

The photographic evidence of the premise shows the premise was fully renovated, except the carpet, prior to the tenancy commencing, that the tenants kept more than the one outside dog permitted in the tenancy agreement and that up to 4 dogs were residing at the premise and were allowed to be inside the house. The dogs caused much of the damage the landlord is seeking compensation for. The evidence proves the damage is careless damage that was reasonably foreseeable by the tenants when the tenants chose to house up to 4 dogs inside the house and the other non-dog related damage is also from the tenants’ careless acts or omissions. Therefore, I find the damage is more than fair wear and tear, and the tenants are responsible for the cost of the repairs. The tenants have not disproved liability for the damage.

The amounts ordered are proved.

I have considered betterment and depreciation. The landlord should be returned to the position they would have been in had the tenant not breached their obligations and should not be better or worse off. In calculating depreciation, I have considered the age and condition of the items at the start of the tenancy and their likely useful lifespan. Specifically, I have depreciated the cost of the flooring cover replacement as the flooring was not new at the start of the tenancy. Fifty percent deduction was made for the depreciation of these costs.

The landlord lost rent for 65 days because of the type and amount of careless damage caused by the tenants. The landlord has been awarded the 65 days lost rent incurred.

Did the tenants fail to quit the premise without reasonable excuse?

[The landlord] claims the tenant did not vacate the premises on 30 June 2024, the date the tenants gave as their last day of the tenancy in their notice ending the tenancy issued to the landlord by email on 29 May 2024.

The landlord had to make an application to the Tribunal to end the tenancy because the tenants had failed to quit the premise on 30 June 2024 without reasonable or lawful excuse.

The Tribunal terminated the tenancy and granted possession back to the landlord at 5pm on 2 July 2024 in an Order NZTT 4898284 dated 2 July 2024.

The tenants still did not vacate the premise within 48 hours after the eviction notice was given to them and the tenancy ended on 9 July 2024 when the landlord had a bailiff issue an eviction order on them and evicted them from the premise.

A tenant must vacate the premises on the termination of the tenancy. See section 40(1)(e)(i) of the Residential Tenancies Act 1986.

Breaching this obligation without reasonable excuse is an unlawful act for which exemplary damages may be awarded up to a maximum of $1,500.00. See section 40(3A)(a) and Schedule 1A Residential Tenancies Act 1986.

The tenants did not vacate the premise, without reasonable excuse, upon termination of the tenancy on multiple occasions and put the landlord to the cost, stress and inconvenience of having to apply to the Tribunal and then apply for an eviction warrant and a bailiff to evict the tenants that continued to refuse to vacate the premise and give the landlord possession. I find they have committed an unlawful act.

Where a party has committed an unlawful act intentionally, the Tribunal may award exemplary damages where it is satisfied it would be just to do so, having regard to the party’s intent, the effect of the unlawful act, the interests of the other party, and the public interest. See section 109(3) Residential Tenancies Act 1986.

I am satisfied the tenants intentionally refused to vacate the premise on a number of occasions and that they intentionally put the landlord to the cost, stress and inconvenience of evicting them and find it would be just to require the landlord to pay a sum of $1,500.00 in exemplary damages because: a. The tenants intentionally did not vacate the premise without reasonable excuse until they were forced to leave under the supervision of a bailiff; b. The landlord is entitled to rely on tenants vacating the premise after they have given notice and/or when the Tribunal has issued an Order granting possession back to the landlord that is enforceable within 48 hours of its issuance; c. It is in the interests of the landlord to receive exemplary damages for the tenants breach of its obligations to vacate the premise on termination of the tenancy; and d. it is in the public interest for tenants’ to be penalised as a disincentive to breaching their obligations vacate the premise on termination of the tenancy. Reimbursement of filing fee
