The landlord has applied for rent arrears, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy. Background:
This was a 12-month fixed term tenancy that commenced on 13 July 2024. The property was newly built, and these tenants were the first to rent the property.
The tenants got into rent arrears and the landlord communicated with the tenants about the rent arrears. The tenants advised the landlord on 29 April 2025 that they had moved out of the property the month before. They advised that they could not afford the rent and so had just left the property without notice to the landlord.

The tenancy ended on 27 June 2025. The landlord provided rent records and water rates invoices which prove the amount owing at the end of the tenancy.

I am satisfied that the landlord has proven their claim for rent arrears and water bills.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii) -(v) Residential Tenancies Act 1986. The tenant is required to replace worn out smoke alarm batteries during the tenancy. See section 40(1) (ca) Residential Tenancies Act 1986. The tenant must also replace standard light bulbs.
The tenant did not leave the premises reasonably clean and tidy and did not remove all rubbish.
The tenants left some rubbish at the property, there was an extensive cockroach infestation, stains on the carpet and drawing on the walls.
The landlord has provided the pre let inspection report and photos and the end of the tenancy photos and inspection. The photos show the rubbish left, extensive cockroach infestation, stains on the carpets and drawing on the walls.
The landlord also provided the Tribunal with invoices for the costs involved in tidying up the property as follows: -De-bug Pest Control dated 6 May 2025 for $195.00 -Steve’s Handyman Services Limited dated 29 May 2025 for $218.50 to remove the rubbish, mow the lawns, tidy the garden, and replace the heat pump batteries. -The Clean Department dated 10 May 2025 for $603.75 for cleaning the house, removing stains and drawings.
The landlord had to replace the batteries in the heat pump remote.
