Only the landlord attended the hearing, which was held by video conference. I am satisfied that the tenant has been served with the landlord’s application in accordance with the provisions set out in the Residential Tenancies Act 1986 and so the hearing proceeded in the tenant’s absence.
This was a very short tenancy of approximately six weeks, beginning on 8 May 2025 and ending on 26 June 2025. Rent was $460 per week.
The landlord has applied for rent arrears, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.

How much is owed for rent and water rates?

The landlord provided rent records showing that rent was in arrears in the amount of $2,825.71 at the end of the tenancy.
The landlord provided a water invoice in the amount of $55.75 (excluding fixed charges) which was owing at the end of the tenancy.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
The tenant did not leave the premises reasonably clean and tidy, and did not remove all rubbish. The landlord produced photos showing that property had not been cleaned properly and the carpet was heavily stained throughout.
The landlord produced an invoice for cleaning in the amount of $460.00. Half of this amount was for cleaning the carpet. I consider the invoices to be reasonable given the condition of the property.
The landlord produced photos showing that a large amount of rubbish was left behind. The landlord produced an invoice in the amount of $402.50 for rubbish removal which I consider reasonable given the amount of rubbish.
The tenant did not return the keys. The landlord produced an invoice for changing the front door lock in the amount of $109.25.
The landlord said that various chattels were missing at the end of the tenancy including mirrors, curtain ties and a heated towel rail. I am unable to find these proven as there were no entry inspection photos showing these items. I accept that the heat pump remote had to be replaced. The landlord produced an invoice for the heat pump remote in the amount of $97.75.
The amounts ordered are proved.

Is the tenant responsible for the damage to the premises?

A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission. See sections 40(2)(a), 41 and 49B RTA.
Where the damage is caused carelessly, and is covered by the landlord's insurance, the tenant's liability is limited to the lesser of the insurance excess or four weeks' rent. See section 49B(3)(a) RTA.
The landlord said that the carpet was brand new at the start of the tenancy but was badly stained and had burn marks at the end of the tenancy and had to be replaced.
The landlord said that the tenant had a dog at the property, in breach of the tenancy agreement, which may have contributed to the carpet damage.
The landlord produced photos at the end of the tenancy, and then after cleaning. The photos show stains in the lounge, bedroom 1 and bedroom 2, and several burn marks.
The landlord has claimed against their insurance and has been charged an excess of $1500 for the damage.
The landlord has proved that the damage occurred during the tenancy and is more than fair wear and tear. The damage is careless. The tenant must compensate the landlord for the insurance excess.
I do not consider that any amount should be deducted for depreciation as the carpet was new at the start of the tenancy. Filing fee and name suppression
The landlord has substantially succeeded with the claim and so I have reimbursed the filing fee.
The landlord did not seek an order for name suppression.
