The landlord attended the hearing. Two out of the three tenants attended the hearing.

The premises comprises three dwellings at the one address. The tenants who appeared mainly lived in a sleep out on the property. They are the adopted daughters of the third tenant.

The tenants had an agreement about the payment of weekly rent. The rent summary shows that payments were irregular and often changed.

During the evidence it was clear to me the tenants who appeared had little to do with the matters the subject of this application. They were not really in a position to challenge the landlord’s claims. They have appeared today as courtesy to the Tribunal, but they consider it is the third tenant who should be answering to the landlord’s claims.

I explained to them that they are jointly and severally all liable, even if the condition of the property at the end of the tenancy was not caused by them.

The landlord has applied for rent arrears, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.

How much is owed for rent and water?

The tenancy ended on 30 September 2025. The landlord provided evidence which established the amounts ordered above for water and rent were owing by the tenants at the end of the tenancy.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.

The tenant did not leave the premises reasonably clean and tidy, and did not remove all rubbish. Photographs shown to me established there was cleaning required to bring the premises up to a reasonable clean standard. The curtains were dirty and had to be washed. There were stains in the carpet and carpet cleaning was undertaken. Rubbish was left behind and the lawns needed some attention.

The tenant did not return the keys, remotes and door cards.

The curtain ties were all missing at the end of the tenancy. These had been brand new.

The amounts ordered above are proved.

Are the tenants responsible for the damage to the premises?

A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission. See sections 40(2)(a), 41 and 49B RTA.

Tenants are liable for the cost of repairing damage that is intentional or which results from any activity at the premises that is an imprisonable offence. This applies to anything the tenant does and anything done by a person they are responsible for. See section 49B(1) RTA.

Damage is intentional where a person intends to cause damage and takes the necessary steps to achieve that purpose. Damage is also intentional where a person does something, or allows a situation to continue, knowing that damage is a certainty. See Guo v Korck [2019] NZHC 1541.

The landlord is claiming for the cost of replacing carpet in the bedrooms and rumpus in one dwelling and in the middle bedroom in another dwelling. Some of the floor had been damaged by a dog and the stains could not be removed.

I am satisfied this was deliberate and intentional damage, that it was more than fair wear and tear, and the tenants have not disproved liability for the damage.

I consider there should be a reduction again the amount claimed for depreciation. Even though the carpet was brand new at the outset of the tenancy, there would still have been depreciation by the end of the year. I consider the amount ordered above reflects an adequate reduction for depreciation.

I decline to make any award for the further repairs that were required to dents in the walls and paint repair. I consider this to be wear and tear.

Because [The applicant/s] has succeeded with the claim I must reimburse the filing fee.

The landlord is entitled to name suppression because they have been the successful party.
